Tesla CEO Elon Musk is being sued for allegedly selling $7.5 billion worth of Tesla shares in 2022, knowing that his company’s production and delivery figures would be below expectations.

In the lawsuit filed by a Tesla shareholder named Michael Perry, it was claimed that Musk acted knowing that his company’s production and delivery figures would be below expectations when selling Tesla shares worth more than $7.5 billion in 2022.

Perry alleged that Musk abused his position at Tesla and failed to fulfill his fiduciary responsibilities to the company and its shareholders. “Musk abused his position and profited by using insider financial information for his own benefit,” the lawsuit said. The plaintiff asked the court to order Musk to return the profit from this sale to the company.

Perry argued that Musk learned in November 2022 that Tesla would not meet fourth-quarter expectations, selling $7.53 billion in shares before the figures were announced the following January. Tesla shares fell more than 12% to $108 on the first trading day after the figures were announced, down more than 12% to $108.
